Customers can submit a toll dispute, or Informal Review, with NC Quick Pass within 30 days of the date on the NC Quick Pass statement or toll invoice.  

If, after an Informal Review, NC Quick Pass finds the individual liable for the disputed amount and provides the individual with a Final Agency Decision, that individual may contest this determination by filing a Petition for a Contested Case Hearing with the Office of Administrative Hearings (OAH) within 60 days from the date of the Final Agency Decision.

1. Requesting the form

To start a Contested Case against NC Quick Pass, you must complete the Form H-06: General Petition Form.

2. Complete the form

Complete Form H-06 to start a Contested Case. A page of instructions is included in Form H-06 explaining how to complete the form. To ensure a Petition for a Contested Case Hearing is properly initiated and to avoid any undue delay in processing, please read and follow the provided instructions carefully. Failing to fully complete and properly fill in Form H-06 may result in a contested case being dismissed.

Certificate of Service section

The Certificate of Service portion of Form H-06 must be completed to properly begin a contested case. The following information should be entered into the corresponding lines.

  • Line (11) – Beth Smith, Process Agent
  • Line (12) – NC Quick Pass and/or the North Carolina Turnpike Authority
  • Line (13) – 1 South Wilmington Street, 1501 Mail Service Center, Raleigh, North Carolina 27699-1501.

3. File the form

A completed Form H-06 must be filed with the OAH to properly commence a contested case. The instruction page of  Form H-06 explains how to file the form. The form may be filed via email, mail or fax.

4. Pay the filing fee

OAH charges a $20.00 filing fee for each petition  filed. The filing fee must be paid at the time the petition is filed, when the Form H-06 is sent to OAH. Failure to pay this fee or failing to file a Request to Proceed in Forma Pauperis will result in your contested case being dismissed.

  • Filing fees can be paid by either cash, money order, certified check, or checks drawn on an attorney’s trust account.
  • Checks should be made payable to the Office of Administrative Hearings.

5. Serve the form

North Carolina law and the North Carolina Administrative Code mandates that any Petition for a Contested Case Hearing challenging a toll, processing fee or civil penalty levied by NC Quick Pass be served on NC Quick Pass, the North Carolina Turnpike Authority, or the North Carolina Department of Transportation. Service on one or all three of these state agencies may be completed by emailing, delivering, faxing or mailing via First Class or Overnight Express United States Postal Service mail a copy of the completed Petition for a Contested Case Hearing, a fully filled out Form H-06.
